On Friday 9 August 2024, William Fettes, Senior Associate, will present the next SMSF Online Update for DBA Network Pty Ltd with a focus on the latest developments for NALI/E including key insights and tips and traps on the newly enacted legislation — see Treasury Laws Amendment (Support for Small Business and Charities and Other Measures) Act 2023 (Cth).

SMSF trustees and advisers will gain clarity and expert guidance on how NALI/E risks can be managed for FY2025 onwards for both general and specific expenses

Key topics for this session include:

• Understanding the key takeaway points of the new legislation, including the 2 X upper cap on general NALE for SMSFs designed to mitigate tax impacts on lower or nil general expenses.
• Strategies to navigate discount/expense risks under the new rules.
• Understanding the remaining high-risk areas to be wary of including:
• asset specific non-recurrent NALE that can taint all of the relevant income;
• property repairs, improvements and development activities — when will NALI strike? 
• SMSF investments in private companies and unit trusts; and
• the treatment of capital gains comprising a mixture of tainted and non-tainted income.
